NZ Gambling Laws 2026: The Online Casino Gambling Act Explained
The current framework
Two laws matter most. The Gambling Act 2003 is the long-standing framework: it prohibits operating online casinos from within New Zealand and restricts local gambling advertising, but it does not criminalise players who choose to use overseas websites. The Online Casino Gambling Act 2026 then created, for the first time, a way for online casinos to be formally licensed to serve New Zealanders.
What it means for players right now
- You can still play. During the transition, offshore casinos licensed in Curaçao, Malta and Anjouan continue to accept Kiwi players legally.
- Nothing changes overnight for you. The cap and licences apply to operators, not players.
- More consumer protection is coming. Once licensed operators launch in 2027, NZ players will have a local regulator (the DIA) and clearer complaint and harm-minimisation rules.
Sports betting is different
Online sports betting sits under a separate regime. Following 2025 changes to the Racing Industry Act framework, TAB NZ and Betcha hold the domestic licences, and offshore bookmakers are restricted from actively accepting New Zealand business — though, as with casinos, players themselves are not penalised for using offshore sites.
